" ... Arguably, the most important definition found in the UVTA is that of "claim" in § 1(3). A "claim" is simply defined as a "right to payment", but the definition goes on to make clear that the claim exists even if not yet reduced to a judgment or is otherwise contingent. Very simply, a claim arises when the liability is incurred, e.g., it is when the debtor's car hits the hypothetical schoolbus full of plastic surgeons, not when the surgeons' attorney sends a demand letter, files a lawsuit, or obtains a judgment. Because "claim" includes rights to payment which are contingent, the definition picks up personal guarantees, the liability for which arose when the guarantee was entered into, and not (as so many practitioners wrongly presume) when the guarantee was finally called. All of this parallels the definition of “claim” in the Bankruptcy Code. ... "
